Ontario’s Excess Soil Regulation postponed. Give your feedback by April 10

Hi Everyone,

The government has decided to postpone the introduction of the excess soil regulations for one year until they understand the consequences of the legislation. It was clear from the recent webinar you attended that although the reason for the regulation is to encourage the industry to improve soil conservation practices, the unintended consequences could have shut down our sector because the receivers of fill and soil were requiring all fill and soil loads to be tested. In some cases they were refusing to accept fill from small companies because they were afraid of liability exposure.

This issue needs to be dealt with.

We are pleased they have delayed the process. In the meantime, please take a moment and register your comments here: https://ero.ontario.ca/notice/019-5203.

You have until April 10, 2022 to make your comments heard. It is important that the Ministry understands the negative effects of requiring small loads to be tested. Local advocacy works. Please take the time to comment.
