As of July 1, 2022 the penalty provisions under the OHSA were revised to:
- Increase the maximum fine from $100,000 to $1,500,000 for directors or officers of corporations and to $500,000 for all other individuals.
- Add a list of aggravating factors that the court must consider for the purposes of determining a penalty under the Act.
- Add a new authority under the Act permitting the courts to impose an order as set in regulation, on convicting a defendant, in addition to any fine or imprisonment imposed.
- Extend the limitation period for instituting a prosecution from one year to two years. For clarity despite this change in the limitation period there will be no change in operational policies with regard to the completion of briefs.
